# Terms of use > These Terms govern the use of Matilha. By creating an account or continuing to use the app, you agree to them and to the Privacy Policy. By creating an account or continuing to use the app, you agree to them and to the Privacy Policy. If you do not agree, do not use the app. ## 1 What Matilha is Matilha is an app for riders to organize rides, save routes, find stops and keep their groups in one place. Matilha **is not a transport, tourism or navigation company**. We do not organize rides, we do not lead anyone, we do not provide assistance and we are not responsible for what happens on the road. Rides are set up by users; whether to go is your decision. ## 2 Who can use it You must be **at least 18 years old** and hold a valid license for the category required by the vehicle you ride. The service is not intended for anyone under 18. Your sign-up information must be true. You are responsible for what happens in your account. Tell us at [contato@matilhaapp.com.br](mailto:contato@matilhaapp.com.br) in case of misuse. ## 3 Riding is at your own risk This is the most important part of these Terms. Riding carries a risk of death and serious injury. By using Matilha, you understand and accept that: **You are solely responsible for your riding**, for complying with traffic laws, for wearing safety gear and for the condition of your vehicle. **Routes and stops are suggestions from other users**, not inspections. They may be outdated, wrong, closed, under construction, poorly paved or dangerous. Check before you go. **Distance, duration, level and track are estimates.** They are not speed recommendations or promises about road conditions. **Navigation is done by third-party apps** (Google Maps, Waze, Apple Maps). We are not responsible for them. **Do not operate your phone while riding.** Stop somewhere safe to use the app. ## 4 Rides and in-person meetups A ride is an in-person meetup between people who may not know each other. The organizer is responsible for the ride they set up; participants, for their own conduct. **We do not check anyone's identity, background, license or vehicle status.** Use common sense: prefer public, busy places, tell someone where you are going and back out if something feels wrong. RSVPs and check-ins exist to help the group get organized. They are not a contract, do not create an obligation to show up and do not mean we have vetted that person. ## 5 Conduct: what is not allowed **There is no tolerance for offensive or abusive content, nor for those who post it.** You may not post, organize, encourage or promote on Matilha: **Street racing or dangerous stunts on public roads** (wheelies, drifting), reckless riding or speed contests — including in photos and videos. Content that encourages riding under the influence of alcohol or drugs. Insults, discrimination, harassment, threats, hate speech or exposure of third parties. Sexual, violent or illegal content, or content that violates the rights of others. Someone else's personal data without authorization; the location of others without consent. Spam, unauthorized advertising, scams, sale of illegal products or parts of dubious origin. Automation, scraping, reverse engineering or any use that harms the operation of the service. Breaking these rules may lead to removal of content, suspension or **permanent termination** of the account, without prior notice when people are at risk. ## 6 User content Content (posts, photos, routes, stops, comments) belongs to whoever posts it. You remain the owner of what you create and grant us a free, non-exclusive, worldwide license to host, display and distribute that content within the app, including previews of shared links. The license ends when you delete the content, except for temporary backup copies and legal retention obligations. **Reporting and blocking.** Every post has options to hide it, report it and block the author. We review reports within 24 hours and remove the content and, where appropriate, the account that posted it. A post reported by three people is taken down automatically pending review. Urgent reports: [denuncia@matilhaapp.com.br](mailto:denuncia@matilhaapp.com.br). A group's internal content is visible only to its members, according to the setting chosen by whoever posted it. We cannot guarantee, however, that a member will not copy or forward that content. ## 7 Groups Whoever creates a group is its leader and is responsible for moderating it: approving members, setting permissions and removing members. A group's internal rules cannot contradict these Terms. ## 8 Subscription and price Without a subscription, you can create an account, set up your profile and see the app's opening screens. Opening content (routes, places, rides, groups, profiles, search) and creating anything requires a monthly or yearly **subscription**. The price is the one shown on the plans screen, in the currency of your store account. Someone who gets a ride link from a friend can, without subscribing, create an account and see that ride. **Free trial.** Only available when the plans screen offers it, for the duration shown there. If you cancel before the trial ends, you are not charged. **Payment and renewal.** You are charged by the App Store or Google Play, on the account used for the purchase, at the price shown on the plans screen before you confirm. The subscription **renews automatically** for the same period unless cancelled at least 24 hours before the end of the current period. **Cancellation.** Cancel any time in your App Store or Google Play account settings (or in Settings → Subscription, which takes you there). Access continues until the end of the period already paid. Deleting your Matilha account does not cancel the subscription in the store. **Price changes.** If the price changes, we will tell you in advance, and the store will ask for your consent where the law or its rules require it. Without your consent, the subscription will not renew at the new price. **Right of withdrawal (Brazilian Consumer Code, art. 49).** You may withdraw within 7 calendar days of purchase and get your money back. Since billing is done by the App Store or Google Play, refunds are requested from them (reportaproblem.apple.com or the Google Play order history page); if that does not work, write to us at [contato@matilhaapp.com.br](mailto:contato@matilhaapp.com.br) and we will help. ## 9 Availability and changes The service is provided as is. We may change, suspend or discontinue features, and failures, downtime and data loss may occur. Keep your own copies of anything important. Relevant changes to these Terms will be announced in the app with reasonable notice. Continuing to use the app after they take effect means you accept the new version. ## 10 Limitation of liability To the fullest extent permitted by Brazilian law, Matilha is not liable for damages arising from accidents, falls, collisions, theft, the conduct of other users, road conditions or the use of third-party navigation apps. Nothing here removes rights guaranteed to consumers by the Brazilian Consumer Code. ## 11 Closing your account You can close your account at any time in Settings → Delete account, or on the website at matilhaapp.com.br/excluir-conta. Closing it removes your access and your personal data as described in the Privacy Policy. ## 12 Governing law and jurisdiction Brazilian law applies.
